IT contracts are notorious for running overtime and overbudget. Approximately 30% of software development projects are never completed and about half of all completed projects are late or overbudget. Procurements of IT related equipment, software or services are frequently high cost and high risk transactions.

Despite this, statistics in the US indicate that over half of all significant IT related procurements proceed on a standard contract provided by the supplier. Experience suggests that the situation is similar in Australia.

Both suppliers and customers who enter into poorly negotiated contracts for the supply of IT related goods or services are exposing themselves to enormous financial and other business risks.

By negotiating in an informed and effective manner, a party can maximise concessions by the other party on contract terms and price and minimise the future problems arising from a poorly documented or one-sided arrangement.
